Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Rhythm, a Progressive Web Application and related services (the "Service") operated by Haptic Analytics Corporation, a Utah corporation ("Company," "we," "us," or "our"). By creating an account, accessing, or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service.

2. Eligibility

You must be at least eighteen (18) years of age to use the Service. By creating an account, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these Terms. We do not knowingly collect data from or provide the Service to individuals under 18. If we learn that a user is under 18, we will deactivate the account and delete the associated data.

3. The Service

Rhythm is a wellness and self-tracking application designed to help users living with cardiac anxiety, ectopic beats, and heart rhythm abnormalities track their symptom episodes, identify potential triggers, and receive conversational support through an AI feature called Rhythm AI.

The Service includes features for logging episodes, viewing pattern observations, running structured hypothesis tests on candidate triggers, and engaging in conversations with Rhythm AI, which is powered by the Anthropic Claude API.

4. Medical Disclaimer

Rhythm is not a medical device. Rhythm is not approved, cleared, or registered with the U.S. Food and Drug Administration (FDA) or any other regulatory body as a medical device. Rhythm is not intended to diagnose, treat, cure, monitor, or prevent any disease or medical condition.

Rhythm is not a substitute for professional medical advice. The information, observations, pattern detection, and AI-generated content provided through the Service are for general informational and self-tracking purposes only. They are not medical advice. You should always consult a qualified healthcare professional regarding any cardiac symptoms, medical conditions, medications, or health decisions.

Rhythm AI is not a medical professional. Conversations with Rhythm AI are generated by an artificial intelligence system. Rhythm AI cannot diagnose conditions, prescribe medications, interpret test results, or provide individualized medical advice. Responses from Rhythm AI should not be relied upon for medical decisions. You should never delay, disregard, or change medical treatment based on anything you read or interact with through the Service.

Pattern observations are not diagnostic. The Service surfaces candidate patterns based on data you log. These observations are correlations only, not causal determinations. The Service cannot determine whether any substance, behavior, body state, or other factor actually causes or contributes to your symptoms. You should not use the Service to self-diagnose or to make decisions about eliminating medications, substances, or treatments without consulting a qualified healthcare professional.

Hypothesis testing is not medical testing. The Service includes a hypothesis testing feature that allows you to track changes during structured periods of eliminating and reintroducing certain substances or behaviors. This feature is for self-tracking purposes only. It is not a clinical trial, not a controlled medical experiment, and not a substitute for medical guidance. Never use this feature to test the elimination of prescribed medications.

In an emergency, call 911 or your local emergency number. Never use Rhythm in place of emergency medical services. If you are experiencing chest pain, severe palpitations, fainting, shortness of breath, signs of a heart attack or stroke, or any other medical emergency, contact emergency services immediately. Do not use Rhythm AI or any other feature of the Service in place of contacting emergency services.

You assume all responsibility for medical decisions. You agree that any decisions you make about your health, medications, lifestyle, or medical care based on information from the Service are made at your own risk and responsibility. We do not warrant the accuracy, completeness, or usefulness of any content within the Service for medical purposes.

5. Account Registration

To use the Service, you must create an account using a valid email address and password. You agree to provide accurate and complete information during registration and to keep your account information updated. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

6. Subscription and Payment

Subscription fees. Access to the Service requires a paid subscription. The current subscription fee is $14.99 per month, billed monthly. We reserve the right to change subscription fees at any time. Any fee changes will be communicated to you in advance and will take effect at the start of your next billing cycle.

Promotional codes. From time to time, we may offer promotional codes that provide free or discounted access to the Service. These codes are subject to their own terms, including expiration dates and usage limits. We do not offer a standard free trial outside of promotional codes.

Payment processing. Subscription payments are processed by Stripe. By subscribing, you authorize us and Stripe to charge your selected payment method on a recurring basis until you cancel. You are responsible for ensuring your payment information remains current.

Auto-renewal. Your subscription will automatically renew at the end of each billing cycle unless you cancel at least 24 hours before the renewal date. You can cancel your subscription at any time through your account settings or by contacting support.

No refunds. All subscription fees are non-refundable. We do not provide refunds or credits for partial subscription periods, unused features, downgrades, or cancellations. If you cancel, you will continue to have access to the Service until the end of your current billing period.

Failed payments. If a payment fails, we may suspend your access to the Service until payment is successfully processed. Repeated payment failures may result in account termination.

7. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the Service in any way that violates applicable laws or regulations
• Use the Service to harm, harass, threaten, defraud, or impersonate any person
• Attempt to gain unauthorized access to other users' accounts or to our systems, servers, or networks
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the Service
• Use the Service to develop, train, or improve any competing product or artificial intelligence system
• Interfere with or disrupt the integrity or performance of the Service
• Upload, transmit, or distribute any malicious code, viruses, or harmful content
• Scrape, harvest, or extract data from the Service through automated means
• Resell, sublicense, or commercially exploit the Service without our express written permission
• Use the Service in any way that could cause harm to yourself or others, including by providing false medical information

8. Rhythm AI

Rhythm AI is a conversational feature powered by the Anthropic Claude API. By using Rhythm AI, you acknowledge and agree that:

• Your messages and relevant logged data will be transmitted to Anthropic for processing
• Rhythm AI responses are generated by artificial intelligence and may contain inaccuracies, errors, or content that is not appropriate for your specific situation
• Rhythm AI is not a licensed therapist, physician, or other healthcare professional
• You will not rely on Rhythm AI for medical, legal, financial, or other professional advice
• You will not use Rhythm AI in a manner that could endanger your safety or the safety of others
• We make no warranties regarding the accuracy, reliability, or suitability of Rhythm AI responses

You may opt out of using Rhythm AI by simply not engaging with the feature. The rest of the Service remains fully usable without it.

9. User Data and Content

Your data. You own the data you provide to the Service, including your logged episodes, profile information, and conversations with Rhythm AI ("Your Data"). By using the Service, you grant us a non-exclusive, worldwide, royalty-free license to access, use, process, store, and transmit Your Data solely for the purpose of providing, maintaining, and improving the Service.

Data processing. We process Your Data in accordance with our Privacy Policy. This includes sharing certain data with our service providers (such as Anthropic for AI processing, Supabase for data storage, and Stripe for payments) as necessary to operate the Service.

Data accuracy. You are responsible for the accuracy and completeness of the information you log into the Service. We do not verify the accuracy of user-submitted data and make no warranties regarding pattern observations derived from inaccurate or incomplete data.

Data export and deletion. You may request access to, correction of, or deletion of Your Data at any time through your account settings or by contacting support. Specific rights and procedures are described in our Privacy Policy.

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to text, graphics, logos, software, design, and the underlying technology — are owned by Haptic Analytics Corporation or our licensors and are protected by copyright, trademark, and other intellectual property laws.

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use. This license does not include any right to copy, modify, distribute, sell, or create derivative works of the Service or its content.

11. Account Termination

Termination by you. You may terminate your account at any time through your account settings or by contacting support. Upon termination, your access to the Service will end at the conclusion of your current billing period.

Termination by us. We may suspend or terminate your account at any time, with or without notice, for any reason, including but not limited to:

• Non-payment of subscription fees
• Violation of these Terms
• Abuse of the Service, our staff, or other users
• Fraudulent, deceptive, or illegal activity
• Conduct that could harm us, our reputation, or other users
• Extended periods of inactivity
• Any other reason at our reasonable discretion

Effect of termination. Upon termination, your right to access the Service will cease immediately. We will deactivate your account and delete Your Data in accordance with our Privacy Policy, except where retention is required by law or for legitimate business purposes.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

14. Indemnification

You agree to indemnify, defend, and hold harmless Haptic Analytics Corporation, its officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of or access to the Service
• Your violation of these Terms
• Your violation of any third-party rights
• Your violation of any applicable law or regulation
• Any decision you make based on information provided through the Service, including medical or health-related decisions

15. Dispute Resolution and Arbitration

Binding arbitration. Any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration in Utah, conducted by the American Arbitration Association (AAA) under its Commercial Arbitration Rules. Judgment on the arbitration award may be entered in any court of competent jurisdiction.

Class action waiver. You agree that any arbitration or legal proceeding shall be conducted on an individual basis and not as part of a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

Exceptions. Notwithstanding the foregoing, either party may seek injunctive or equitable relief in a court of competent jurisdiction to protect intellectual property rights or to prevent unauthorized access to the Service.

Governing law. These Terms are governed by the laws of the State of Utah, without regard to conflict of laws principles.

Venue. For any matter not subject to arbitration, you agree to the exclusive jurisdiction of the state and federal courts located in Utah.

16. Changes to These Terms

We may modify these Terms at any time. If we make material changes, we will notify you by email or through the Service before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must stop using the Service and may cancel your subscription.

17. Miscellaneous

Entire agreement. These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.

Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

Waiver. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment. You may not assign or transfer these Terms without our prior written consent. We may assign these Terms at any time without notice.

No agency. Nothing in these Terms creates any agency, partnership, joint venture, or employment relationship between you and us.

Force majeure. We will not be liable for any failure or delay in performance due to causes beyond our reasonable control, including natural disasters, acts of government, network failures, or other force majeure events.
